By law, a person’s possessions will pass to his/her heirs upon his/her death. If a will is not in existence, the distribution of your estate is pre-determined by the law, without specific regard to your own wishes.
A will and testament, prepared by you with the help of a professional, will enable you to distribute your wealth and possessions to any persons (or organizations) of your choosing. This will enable you to best decide and implement your own wishes ahead of time. A properly written will and testament will eliminate misunderstandings and possible conflicts between your heirs and enable you to make your wishes known clearly and privately - without being subject to undue influence or external pressures.
A joint will prepared with you and your spouse will determine how your joint (or individual) possessions will be distributed after each of you has passed. Often spouses will decide, for example, to bequeath all of their possessions first to each other, and then to jointly decide how to distribute your estate after both of you have passed on. These instructions, for example, will not take place, by law, if a will is not existent.
Other issues that require legal representation include (but are not limited to) registration of a will, submitting a will for execution, challenges to a will, registration of assets in the names of beneficiaries and serving as Executor to the will.
